NEWS: Axl Rose Suing Dr. Pepper
Dec 03, 2008 - By Matt UnangstDr. Pepper promised customers free 20 oz. bottles of the stuff when Guns ‘n Roses released Chinese Democracy. Axl Rose had no direct involvement with the promotion, but is now suing the company for failing to follow through on its promise. Dr. Pepper did give some soda away on November 23, but its website crashed because too many people were trying to get in on the giveaway. The company extended the promo for another day, but Rose claims that the site was still down. Rose’s lawyer has called Dr. Pepper’s actions, “an unmitigated disaster which defrauded customers.”
What does Rose want from Dr. Pepper? He is demanding that Dr. Pepper extend the promotion so that people who didn’t get the free bottle can get it now and that full-page apologies be printed in the LA Times, NY Times, Wall Street Journal, and USA Today. Oh, and he wants some money, claiming that Dr. Pepper violated his intellectual property rights by using his album to promote itself. Dr. Pepper is telling him to go to hell.
Axl Rose be crazy. It is kind of shady for Dr. Pepper to promote itself using Chinese Democracy without paying for it, but Rose can’t pull off this consumer advocate act at all convincingly. He will probably get some money, though, and no one will get any free Dr. Pepper.
